Marketplace Terms of Use for Clients

A public offer explaining how to use the Meeti Me marketplace to find salons and book appointments, what role the platform plays, and what rights the client has.

This translation is provided for convenience. The UK version is the binding one.

1. General provisions

This document is a public offer by DOKUMENT.PL sp. z o.o. (the "Operator", "we") to conclude with you an agreement on the use of the Meeti Me marketplace (the "Marketplace"), available at meeti.me and in mobile applications.

The Operator is a legal entity registered in the Republic of Poland, address: Aleja Stanow Zjednoczonych 51 lok. 222, 04-028 Warszawa, Poland, tax number (NIP): 5242982251, court register number (KRS): 0001055336. The Operator is a non-resident of Ukraine and supplies electronic services into the territory of Ukraine.

The agreement is a contract of adhesion within the meaning of Article 634 of the Civil Code of Ukraine and is concluded in electronic form in accordance with the Law of Ukraine "On Electronic Commerce". You accede to the agreement as a whole.

If you are a consumer within the meaning of the Law of Ukraine "On Consumer Rights Protection", you enjoy all the guarantees established by that Law. No provision of this agreement may be interpreted as limiting your consumer rights. If any provision conflicts with a mandatory rule of law, the rule of law applies.

2. Definitions

Marketplace - the public part of the Meeti Me platform where you can find a salon, view its services and book an appointment.

Salon - a business entity (a legal entity or an individual entrepreneur) that has placed its page on the Marketplace and provides beauty, care or wellness services.

Client, you - a natural person who uses the Marketplace.

Booking (appointment) - a reservation of time, confirmed by the Salon, for the provision of a service to you.

Salon Service - a service the Salon provides to you directly: a haircut, a manicure, a cosmetic treatment and so on.

Account - your user account on the Marketplace.

Review - the rating and text comment you leave about a Salon after a visit.

3. What the Marketplace is and what it is not

The Marketplace is an information and technology service. We display information about Salons and provide the technical means to reserve a time slot.

What we do:

  • we display a list of Salons, their services, prices and available slots based on the information provided by the Salons themselves;
  • we transmit your booking request to the Salon and notify you of its status;
  • we send service messages: confirmations, reminders, notices of change or cancellation;
  • we keep the history of your appointments in your account;
  • we provide the ability to leave a review about a visit.

What we do NOT do:

  • we do not provide beauty, care or wellness services. The service is provided by the Salon using its own resources, its own staff, its own equipment and at its own responsibility;
  • we do not set prices. Prices are determined by the Salon independently. The price shown on the Marketplace is indicative and depends on the actual scope of work, which is determined on site;
  • we are not a party to the agreement between you and the Salon. The service agreement is concluded directly between you and the Salon;
  • we do not accept payment for Salon services. Settlement takes place directly between you and the Salon, as a rule offline at the Salon;
  • we are not an agent or representative of the Salon and do not act on its behalf;
  • we do not verify the qualifications of individual specialists, except where expressly stated otherwise in the description of the relevant feature.

Use of the Marketplace is free of charge for you. We receive remuneration from Salons for subscription access to our software, not from you.

4. Creating an account

You can book an appointment after creating an account or, if the interface provides for it, without registration by providing your name and contact details.

To create an account you need: a name or nickname, an email address or phone number, and a password. You undertake to provide accurate information and keep it up to date: with an incorrect phone number the Salon will not be able to reach you.

An account may be created by a person aged 16 or older. If an appointment is made for a minor, the booking is made by a parent or other legal representative from their own account.

The account is personal. Do not share your password or one-time confirmation codes with other persons. If you believe that a third party has gained access to your account, change your password immediately and notify us at meetime.company@gmail.com.

You may delete your account at any time in the settings or by writing to meetime.company@gmail.com. Deleting the account does not automatically cancel bookings that have already been confirmed: cancel them separately or notify the Salon.

5. Booking, changing and cancelling an appointment

Placing a booking. You choose a Salon, a service, a date and a time from the available slots and confirm the request. The request is transmitted to the Salon.

Confirmation. An appointment is considered made from the moment you receive confirmation from the Marketplace or from the Salon. Some Salons confirm appointments automatically, others manually. If the Salon has not confirmed the request, the service agreement is not considered concluded.

We do not guarantee that the chosen slot is available: the calendar is maintained by the Salon, and in rare cases an overlap is possible. If the slot turns out to be unavailable, we will notify you as soon as possible and offer an alternative available at the Salon.

Change and cancellation by you. You can cancel or reschedule an appointment in your account or via the link in the confirmation email. Please do so in good time: time you have not freed up cannot be offered by the Salon to another client.

The Salon's rules take precedence. Each Salon sets its own rules for cancellation, rescheduling and late arrival: the period within which cancellation is free of charge, the amount of compensation for late cancellation or no-show, and the procedure in case of late arrival. These rules are posted on the Salon's page and are shown before the booking is confirmed. By making an appointment, you agree to the rules of the specific Salon.

Any compensation for late cancellation or no-show is a claim of the Salon against you, not ours. We do not charge or withhold such amounts.

Cancellation by the Salon. The Salon may cancel or reschedule an appointment, including due to a specialist's illness or technical reasons. The Salon is obliged to notify you without delay. We will pass such a notice on to you through the available channels, but we are not responsible for the consequences of a cancellation by the Salon.

What to do if the visit did not take place through the Salon's fault. Contact the Salon first. If the matter cannot be resolved, write to us at meetime.company@gmail.com: we cannot resolve the dispute for you, but we will record your complaint, contact the Salon and take it into account when assessing its continued presence on the Marketplace.

6. Payment for Salon services

Payment for the service is made directly to the Salon, as a rule in cash or by card on site, in the manner established by the Salon.

We do not accept, hold or transfer funds for Salon services. We are not a payment intermediary in your relationship with the Salon.

The settlement document (receipt, invoice, fiscal receipt) is issued by the Salon. Questions concerning the document, the amount, refunds or recalculation are resolved with the Salon.

The price stated on the Marketplace is information provided by the Salon. The final cost may differ depending on the actual scope of work, hair length, materials used and other circumstances. The Salon is obliged to inform you of the final cost before the service begins.

If the Salon requires a prepayment or deposit, it does so outside the Marketplace and under its own rules. We are not a party to such settlements.

7. Reviews

Reviews help other clients choose a Salon. We are interested in their being truthful.

Who may leave a review. A review may be left only by a registered client who has a confirmed completed appointment with that Salon made through the Marketplace. An invitation to leave a review is sent after the date of the visit. One visit - one review.

How we verify that a review relates to a real visit. We match the review against the record in the system: the existence of a confirmed booking, the "completed" status, and the matching date. The Salon marks the client's actual attendance. Reviews that cannot be matched to a visit are not published. We do not accept anonymous reviews from persons without an appointment and do not allow Salons to buy or commission reviews.

If the Salon marked you as a no-show but the visit actually took place, notify us at meetime.company@gmail.com: we will check and restore your ability to leave a review.

Moderation rules. A review is not published or is removed if it contains:

  • obscene language, insults, threats, calls to violence;
  • discriminatory statements on the grounds of sex, age, race, ethnic origin, religion, state of health, sexual orientation or any other characteristic;
  • personal data of third parties: names of staff combined with their contact details, phone numbers, addresses, photographs of people without their consent;
  • information about the state of health of other persons;
  • advertising, spam, links to third-party commercial resources;
  • information unrelated to the visit or to the Salon itself;
  • statements that are manifestly untrue and that you cannot substantiate;
  • a review left by a competitor, an employee of the Salon or a person associated with it.

An "unsatisfactory" rating is not in itself a ground for removal. We do not remove a negative but truthful and properly worded review at the Salon's request.

Handling procedure. The Salon may contest a review by submitting a reasoned request. We consider it within 14 calendar days. Until the review is complete, the review remains published, except in cases of an obvious violation (obscene language, personal data of third parties, threats), when it is hidden temporarily.

Your right to contest removal. If we have not published or have removed your review, we notify you of this, stating the ground. You may contest the decision by sending an objection to meetime.company@gmail.com within 30 calendar days. We will reconsider it, involving a different member of staff, and provide a reasoned response within 14 calendar days. If the objection is upheld, the review is reinstated.

The Salon may respond publicly to a review. The Salon's response is subject to the same moderation rules.

You remain the author of your review. By publishing it, you grant us a non-exclusive royalty-free licence to display it on the Marketplace and in materials promoting the Marketplace, with your name or nickname stated as it appears in your account.

8. Prohibited conduct

When using the Marketplace, you undertake not to:

  • create appointments without the intention of visiting the Salon, including bulk-booking slots;
  • create multiple accounts to circumvent restrictions or a block;
  • impersonate another person or use another person's contact details;
  • enter knowingly false information;
  • use automated means to access the Marketplace, to collect data in bulk (scraping), to create appointments or to submit reviews;
  • attempt to gain unauthorised access to the Marketplace, other users' accounts or Salons' systems, probe for vulnerabilities without our permission, or circumvent technical restrictions;
  • upload malicious code or create excessive load on the service;
  • use the Marketplace to advertise third-party services, send spam, or recruit Salon staff;
  • infringe the intellectual property rights of the Operator, the Salons or third parties;
  • harass, insult or threaten Salon staff or other users.

If you breach these rules, we may, depending on the severity of the breach: warn you, hide your review, restrict your ability to book, or temporarily suspend or block your account.

We notify you of a restriction, stating the ground. You may contest it at meetime.company@gmail.com; we will consider your objection within 14 calendar days. Immediate blocking without prior warning is applied only for gross violations: hacking attempts, fraud, threats.

9. Liability

What the Salon is liable for. The Salon is independently and fully liable for: the quality and safety of the service provided, the qualifications of its staff, the materials and products used, compliance with sanitary requirements, the accuracy of the description of services and prices, honouring confirmed appointments, harm to your health or property caused in the course of providing the service, and the issuance of settlement documents.

Claims concerning the service are addressed to the Salon. Your consumer rights under the Law of Ukraine "On Consumer Rights Protection" are exercised against the Salon as the service provider.

What we are liable for. We are liable for the operation of the Marketplace: for its being available, for your booking request being transmitted to the Salon, and for your data being processed in accordance with the Privacy Policy.

We are not liable for:

  • the accuracy of information posted by a Salon (prices, descriptions, opening hours, photographs);
  • the actions or omissions of a Salon, including cancellation of an appointment, delays, or refusal to receive a client;
  • the quality of Salon services and the consequences of their provision;
  • settlements between you and the Salon;
  • the content of reviews left by other users;
  • unavailability of the Marketplace due to circumstances beyond our reasonable control: failures of communication channels, actions of infrastructure providers, power outages, armed aggression, acts of public authorities, denial-of-service attacks.

To the extent permitted by law, our liability for losses caused by a malfunction of the Marketplace is limited to actual, documented losses.

The limitations of liability do not apply to harm caused intentionally or through gross negligence, to harm to life and health, to liability for breach of personal data protection legislation, or in other cases where mandatory rules of law do not permit limitation of liability towards a consumer.

10. Personal data

We process your personal data in accordance with the Law of Ukraine "On Personal Data Protection". A full description is set out in the Privacy Policy, available at meeti.me.

In brief: we collect account data and booking data in order to create an appointment and pass to the Salon the information needed for your visit. The Salon receives your name, contact details, the chosen service, the date and time, and your comment.

For account data and the operation of the Marketplace, the data controller is the Operator. For notes that a Salon keeps about you in its own records, the controller is the Salon, and we act as a processor.

Service messages (confirmations, reminders, cancellations) are part of the service. Marketing messages are sent only with your separate consent, which you may withdraw at any time.

Send requests concerning your data to meetime.company@gmail.com or meetime.company@gmail.com. We respond within 30 calendar days.

11. Right to withdraw from the agreement within 14 days

The Law of Ukraine "On Consumer Rights Protection" grants the consumer the right to withdraw from a distance contract within 14 days of its conclusion, without giving reasons.

As regards the agreement with us. The agreement on the use of the Marketplace is free of charge for you. You may terminate it at any time by deleting your account, without any payments and without giving reasons. No separate withdrawal procedure is required.

As regards an appointment with a Salon. A booking is not a separate paid contract with us: the service agreement is concluded between you and the Salon. Cancellation of an appointment is carried out in the manner described in section 5, subject to the rules of the specific Salon.

An important statutory caveat. The right to withdraw from a contract within 14 days does not extend to contracts for the provision of services related to leisure, recreation or catering, or to contracts in which the provider undertakes to provide the service on a specific date or within a specific period. A beauty service booked for a specified date and time generally falls into this category. This means that once the date of the visit has passed, a refund cannot be claimed on the basis of the right of withdrawal.

In addition, if the provision of the service began with your express prior consent and the service has been provided in full, the right of withdrawal also does not apply.

These limitations concern your relationship with the Salon. The specific terms of cancellation and refund of prepayments are determined by the Salon in its rules. This does not deprive you of the right to require the Salon to remedy defects, reduce the price or compensate for harm if the service was provided improperly: such rights are provided by law and are not limited by this section.

12. Complaints and response times

If you are dissatisfied with the operation of the Marketplace, write to us. We want to resolve the issue, not to argue.

What to include: your name and contact details, the date and time of the event, the name of the Salon and the appointment number (if the enquiry concerns a booking), a description of the problem and what you expect from us.

Time limits. We acknowledge receipt of an enquiry within 2 business days. We provide a reasoned response on the merits within 30 calendar days of receiving the enquiry. If more time is needed, we will notify you before that period expires, stating the reason and an estimated new time limit.

Handling of enquiries is free of charge.

Complaints about a Salon's service are handled by the Salon. We will forward your enquiry to the Salon and, if you wish, stay in touch. We have no authority to compel a Salon to refund money or reschedule a visit, but systematic violations are taken into account when deciding on the Salon's continued presence on the Marketplace.

You may also apply to the State Service of Ukraine on Food Safety and Consumer Protection or to a court. Contacting us is not a precondition for doing so and does not deprive you of any other remedy.

13. Changes to the terms

We may change these Terms if the functionality of the Marketplace or legal requirements change.

We give notice of material changes by email to the address specified in your account and by a notice in the interface no later than 14 calendar days before the date they take effect.

If you do not agree with the changes, you may stop using the Marketplace and delete your account before the date they take effect. Continued use after that date constitutes acceptance of the new version.

Changes do not apply to bookings that have already been confirmed: the version in effect at the time the appointment was made applies to them.

The current version is always available at meeti.me, with the version number and effective date stated. Previous versions are kept in an archive and provided on request.

14. Governing law and dispute resolution

Governing law: law of Ukraine. The choice of law does not deprive you of the protection afforded by the mandatory rules of the law of the state of your habitual residence.

Disputes are heard by the courts of: courts of Ukraine at the consumer place of residence. This does not deprive you, as a consumer, of the right to apply to the court at your place of residence or at the place of performance of the contract in accordance with the Law of Ukraine "On Consumer Rights Protection" and procedural legislation.

You are exempt from paying court fees in cases concerning consumer protection claims in the instances provided by law.

15. Miscellaneous

If an individual provision of these Terms is held invalid, this does not affect the validity of the remaining provisions. The invalid provision is replaced by the rule of law closest to it in substance.

We may transfer our rights and obligations under the agreement to a successor in the event of a reorganisation or sale of the business, giving you advance notice. Your position will not be worsened as a result.

The platform, its code, design, interfaces, trademarks and domain names belong to the Operator. You receive the right to use the Marketplace for its intended purpose and acquire no intellectual property rights.

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and us regarding the use of the Marketplace.
